Terms of Service

Who we are
This website, verticalhorizon.ai, is operated by Vertical Horizon AI LLC, an Arizona limited liability company based in Tucson, Arizona (“VerticalHorizon”, “we”, “us”). These terms govern your use of the website and the material published on it. By using the site you agree to them. If you do not agree, please do not use the site.
What the site is for
The site describes our practice: how we take on software commissions, how our VerticalHorizon Singularity platform builds to a governed specification, and what we hold ourselves to. It is published for information. Nothing on it is an offer that can be accepted by using the site, and nothing on it forms a contract for a commission.
Commissions are governed by their own written agreement. The scope, price, dates, ownership of the specification and the delivered software, and every other term of an engagement are set out in the agreement we sign with each client. Where these website terms and a signed agreement differ, the signed agreement controls.
Case studies and synthetic builds
Real client work is confidential and does not appear on this site. The builds we publish as case studies are labelled as synthetic where the company, its people and its circumstances are invented so that the method can be shown in full. The artifacts behind them — the specifications, gate verdicts, rulings, scorecards and phase reports — are real outputs of our process, and figures quoted from them are the figures those runs produced. They illustrate how the method behaves. They are not a promise of the price, timeline or outcome of any particular commission, which depend on the specification agreed for that commission.
Downloads
Some documents on the site, such as sample specifications, proposals and our deck, are made available to download, in some cases after a request that we approve. They are provided for your own evaluation of our work. You may read them and share them within your organisation for that purpose. You may not publish them, sell them, present them as your own, or use them to build a competing offering.
Intellectual property
The site, its text, design and images, and the names VerticalHorizon, VerticalHorizon Singularity and 100Startups are ours, or used with permission, and are protected by copyright and trademark law. You may quote short passages with attribution and link to any page. Beyond that, nothing on the site may be reproduced without our written consent.
What you send us
When you contact us, request a download, subscribe to a newsletter or join a waitlist, you confirm that what you send is accurate and yours to send. We treat what you tell us about your business as confidential. We use it to respond to you and as described in our Privacy Policy. Please do not send us confidential information through the site before we have agreed in writing how it will be handled; a conversation is the right place for that.
Acceptable use
You agree not to:
- attempt to gain access to parts of the site or its systems that are not open to the public, including tools protected by a password;
- scrape, crawl or copy the site other than as a search engine indexes a public page;
- submit forms with false information, or in bulk, or by automated means;
- interfere with the site’s operation or the experience of other visitors.
Third-party links
The site links to other sites, including GitHub, LinkedIn and the sites of organisations we mention. We do not control them and are not responsible for their content or their handling of your data.
No warranty for the site
We keep the site accurate and available as best we can, but it is provided as it is, without warranty of any kind. Information on it may be incomplete or out of date, and we may change or remove it at any time. Nothing on the site is professional, legal or financial advice.
Limitation of liability
To the extent the law allows, VerticalHorizon is not liable for any loss arising from your use of, or inability to use, the site or its content, including indirect or consequential loss. This does not limit any liability that cannot be limited by law, and it does not apply to the terms of a signed commission agreement, which has its own provisions.
Governing law
These terms are governed by the laws of the State of Arizona, without regard to its conflict of laws rules. Any dispute about the site that cannot be resolved by talking to us will be brought in the state or federal courts located in Pima County, Arizona.
